Scope of Application
This EULA applies to Gaming Mood Tracker – Tiltless and
all other applications, services,
and products published, owned, or operated by Appcaster Technologies CO. L.L.C S.O.C
,
unless explicitly stated otherwise. Any reference to “App”, “we”, “us”, or “our” refers to all such
applications and related services.
1. License Grant
The Developer grants the user a limited, non-exclusive, non-transferable, revocable license to
use the App for personal, non-commercial purposes only. Any other use is strictly prohibited
without the Developer’s prior written consent.
2. Restrictions
Users may not:
- Copy, reproduce, modify, distribute, publicly display, or create derivative works of the App
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover source code
- Circumvent, disable, or bypass any security, protection, or licensing mechanisms
- Use the App for commercial purposes, including resale or monetization
- Attempt to access features or data not intended for the user
3. Ownership
The App, including all software, content, designs, trademarks, logos, and branding, remains
the exclusive property of the Developer. Nothing in this EULA transfers ownership to the user.
4. Updates, Modifications, and Availability
The Developer reserves the right to modify, suspend, or discontinue the App, features, or
content at any time without prior notice or liability.
5. Data Collection and Third-Party Services
The App may collect any data generated by or associated with the use of the App, including but not limited to:
- Device information, operating system, app version
- Usage statistics, session times, and interaction data
- User-generated content (mood inputs, notes, tags)
- Advertising identifiers and engagement with ads
- Data from third-party SDKs and services
- Any other data at the Developer’s sole discretion
The App may integrate third-party SDKs for analytics, advertising, or other services. Users acknowledge this and accept these terms.
6. Subscriptions, Purchases, and Offers
The App
may include subscriptions of any duration, one-time purchases, special offers,
seasonal promotions, or other purchase options
, all at the Developer’s discretion.
The rules for payments, renewal, expiration, and cancellation are determined by the
app store
platform
for each specific offer. Users accept responsibility to manage subscriptions and
purchases according to platform policies.
7. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind,
whether express, implied, or statutory, including but not limited to:
- Accuracy, reliability, or completeness of data
- Emotional, psychological, or behavioral effects
- Fitness for a particular purpose
- Non-infringement of third-party rights
8. Limitation of Liability
To the maximum extent permitted by law, the Developer is not liable for:
- Emotional or psychological effects
- Behavioral outcomes
- User-generated content
- Data loss, corruption, or misinterpretation
- Direct, indirect, incidental, special, consequential, or punitive damages Even if advised of the possibility of such damages. Users accept full responsibility for use.
9. Assumption of Risk
Users acknowledge that use of the App is entirely at their own risk, including all features, content, and collected data.
10. Intellectual Property and Copyright
All rights, title, and interest in the App, including updates, modifications, and derivative works,
remain exclusively with the Developer. Any unauthorized use, reproduction, distribution, or
modification may result in civil and criminal liability
11. Governing Law
Users acknowledge that use of the App is entirely at their own risk, including all features, content, and collected data.
12. Changes to the EULA
The Developer may update or modify this EULA at any time. Continued use of the App constitutes acceptance of the updated terms.
